2. The Agreement and the Enrolment Documents
2.1 Your booking, once accepted by us, creates a legally binding contract governed by: (a) these Terms; (b) the booking form; (c) the Confirmation; and (d) the Enrolment Documents referred to below (together, the "Agreement"). The Agreement is the entire agreement between you and us and supersedes any prior understanding.
2.2 Before the Arrival Date you must complete, sign and return the following Enrolment Documents, which form an integral part of the Agreement:
- the Code of Conduct, Assumption of Responsibility and Authorization to Participate;
- the Privacy Notice (Articles 13 and 14 GDPR) and the separate consent for the use of images and audio/video recordings;
- the Participant Health Form and Authorization for Emergency Management.
2.3 If any Enrolment Document is not signed and returned within the time we reasonably require, we may be unable to admit the Student to the Course, and clause 6 (cancellation) will apply.
2.4 Where there is any conflict between these Terms and an Enrolment Document on the same subject, the document that deals with that subject in the greater detail shall prevail; on matters of participation, conduct, health and data protection, the relevant Enrolment Document prevails.
3. Bookings
3.1 We strongly recommend booking as early as possible; places are limited and allocated on a first-come, first-served basis.
3.2 All bookings must be made by the Parent or a legal guardian of the Student (or by an authorised agent on their behalf). Your booking is an offer to enter into a contract with us; it is accepted only when we issue a Confirmation. We may accept or decline any booking at our reasonable discretion, for example where a Course is full or unsuitable for the Student.
3.3 Where the Student's age falls within 12 months of a Course's stated age range, we may accept the booking following discussion between us and the Parent as to the most suitable Course.
3.4 It is your responsibility to check that the information in the booking form and Confirmation is accurate and complete. If you believe there is an error or omission, please tell us before the Course begins and obtain our written confirmation of any agreed change.
3.5 In exceptional circumstances beyond our reasonable control we may need to change the Course location; we will inform you promptly. Save as required by mandatory law (including clause 15), we are not liable for incidental costs arising from such a change.
3.6 We will try to meet specific accommodation requests but cannot guarantee them unless agreed in writing as a condition of booking. Accommodation is arranged to encourage interaction among students of different nationalities, with English as the common language.
4. Late Applications and Contact Details
4.1 If you apply within 10 working days of the Course Start Date and do not receive joining instructions within 2 working days, please contact us at info@sportechacademy.com.
4.2 You must provide accurate contact details when booking and keep them up to date, as we may need to contact you in the two weeks before the Course Start Date. Please wait for our Confirmation before making any travel or accommodation arrangements; we are not responsible for travel or accommodation costs incurred before a Confirmation is issued.
5. Deposit, Fees and Payment
5.1 The Fees for each Course are published at www.sportechacademy.com and are set out in your invoice and Confirmation. All Fees and the Deposit are payable in Euro (EUR). Once a Confirmation is issued, no change to the Fees will apply to your booking unless agreed in writing by both parties.
5.2 The Deposit must be paid within 48 hours of the Booking Reserved email. If it is not paid by then, we may cancel the booking and release the place.
5.3 The balance of the Fees must reach us by the Payment Due Date. Bookings made after the Payment Due Date must be paid in full within 48 hours of the Booking Confirmation email. Please quote the Unique Statement Number shown in your Confirmation with every payment.
5.4 Payments may be made online via our Flywire platform or, where Flywire is unavailable, by bank transfer. Payments should be made only after you have received both our invoice and the Confirmation.
5.5 If you do not pay in accordance with this clause 5, we may cancel the booking and the Student will not be entitled to begin the Course.
5.6 Price errors. We take care to ensure the Fees are correct. If a Fee is obviously and unmistakably mispriced, and the error could reasonably have been recognised by you, we are not obliged to provide the Course at the incorrect price; we may cancel the affected booking and refund any sums you have paid for it.
5.7 Late payment. If any amount due is not paid by its due date, we may charge interest on the overdue amount at the Italian statutory (legal) interest rate from the due date until payment is received, without prejudice to our right to cancel under this clause 5.
6. Cancellation by You
6.1 Right of withdrawal. The Courses are recreational and educational services provided on specific dates and for a specific period. Accordingly, under Article 59, paragraph 1, letter n) of Legislative Decree No. 206/2005 (the Italian Consumer Code), the statutory 14-day right of withdrawal for distance contracts does not apply to your booking. The voluntary cancellation terms in clause 6.2 apply instead.
6.2 You may cancel your booking at any time by written notice to info@sportechacademy.com, effective when we receive it. The following applies to Fees already paid:
- more than 30 days before the Arrival Date: we will refund 50% of the Fees paid. The Deposit is non-refundable, as it covers costs committed at the time of booking;
- within 30 days of the Arrival Date (i.e. 30 days or fewer before it): no refund of any kind is due, because staffing, transfers, accommodation and other Course elements have by then been committed on your behalf. This applies except in the case of a valid visa refusal under clause 9, or otherwise at our sole discretion;
- once the Course has started: if the Student leaves the Program at any time, for any reason, or does not attend, no refund or credit is due.
6.3 Amounts we retain reflect the costs and commitments we reasonably incur in preparing for the Student's participation. If, in a particular case, the costs actually committed are lower, we will act reasonably and in good faith in applying this clause.
7. Cancellation and Changes by Us
7.1 We may cancel a Course up to 10 Business Days before the Course Start Date if there is insufficient demand; in that case we will refund all Fees paid, including the Deposit.
7.2 If an event beyond our reasonable control prevents us from delivering your Course, clause 16 (Force Majeure) applies.
7.3 We may make reasonable changes to the content or timetable of a Course; where a change is significant we will inform you as soon as possible.
8. Refunds
8.1 Refunds are made only where these Terms provide for them. No refund is due after the Course Finishing Date.
8.2 Refunds are paid in EUR using, where possible, the original payment method. We are not responsible for bank charges or exchange-rate differences. Refunds made where payment was received via international bank transfer may take longer to process. Where a booking is cancelled or rejected by us, we will refund Fees due within 14 days where payment was made via Flywire.
8.3 This clause does not affect any mandatory refund rights you may have as a consumer under Italian law.
9. Visa Support and Visa Refusal
9.1 It is your responsibility to determine whether the Student needs a visa and to allow enough time to obtain one. We strongly recommend applying as early as possible.
9.2 Where a Schengen visa is required, we will provide a visa support letter for a Standard Schengen visitor visa application after payment of the Deposit, upon receipt of a copy of the Student's passport. Where a booking is made after the Payment Due Date, the support letter will be issued only once the Fees are paid in full.
9.3 If the visa is still pending at the Course Start Date, we will offer either a refund of Fees paid less the Deposit, or a credit note for the following year.
9.4 In the event of a visa refusal, we will refund the Fees paid, less an administrative fee of €250, provided that: (a) the application was submitted in good time and after the Payment Due Date but before the Arrival Date; (b) all required documentation was provided and the application was accurate and free of material error; (c) you notify us at least ten days before the Course Start Date; and (d) you provide a valid refusal letter or official communication from the competent Embassy, Consulate or visa authority as evidence. Failure to meet these conditions, or the Student's non-attendance, results in no refund.
9.5 If the visa is granted after the Course Start Date and the Student still wishes to attend, please contact us; we will try to accommodate the Student subject to availability.
10. Amendments to Bookings
10.1 Amendment requests may be made to info@sportechacademy.com or by phone on +39 346 3838393 and are subject to availability. If the Student leaves the Course early, no refund or credit is due. Extensions may incur an additional fee and are subject to availability.
10.2 Where public authorities impose measures (such as quarantine or testing) affecting participation, any resulting additional costs are the Parent's responsibility; we will act reasonably and keep any such costs to the minimum necessary. Clause 16 also applies.
10.3 Amendments requested after the Course Start Date may result in missed Course elements and additional charges. Any amendment is at our reasonable discretion.
11. Complaints
11.1 If you have a concern during the Course, please tell the School Manager immediately so it can be addressed promptly. If it is not resolved, you may escalate it to our Customer Service team, and thereafter to the Operations Director, at info@sportechacademy.com.
11.2 Any compensation is at our reasonable discretion and will not be offered for minor inconveniences or for matters caused by events beyond our reasonable control (see clause 16). This does not limit your mandatory rights as a consumer.
12. Code of Conduct and Removal from the Program
12.1 Students must behave responsibly and comply with the Code of Conduct in the Enrolment Documents and the SPORTECH Student Handbook.
12.2 We may remove a Student who seriously breaches the Code of Conduct, or whose behaviour endangers themselves or others, or which constitutes a civil or criminal offence. Where a Student is removed on these grounds, no refund is due, the Parent is responsible for arranging and paying the costs of the Student's return, and our right to claim damages is preserved, as further set out in the Code of Conduct.
13. Insurance
13.1 SPORTECH maintains third-party (general) liability and accident insurance in respect of its programs. This cover is not medical or health insurance and does not cover the Student's medical treatment, repatriation, personal belongings, or trip cancellation.
13.2 It is a condition of participation that the Student holds valid, comprehensive travel and medical insurance covering the whole period of the Course in Italy (including medical treatment, hospitalisation and repatriation). You must provide the insurer's name, policy number and 24-hour emergency contact in the Health Form before the Arrival Date. Details of SPORTECH's liability and accident cover are available on request.
14. Health, Safety and Safeguarding
14.1 You must disclose in the Health Form all information relevant to the Student's health, allergies, dietary needs, medication and any special requirements, and keep it up to date. The Health Form includes your authorization for first aid and emergency medical management; SPORTECH does not provide medical services, and all clinical decisions rest with healthcare professionals.
14.2 The welfare and safety of participants is our priority. SPORTECH applies safeguarding measures appropriate to a program for minors, including supervision arrangements suited to the activities and the verification of staff who work with minors as required by applicable Italian law (including the criminal-record certificate under Legislative Decree No. 39/2014). Supervision arrangements, including night-time arrangements, are described in the Code of Conduct.
14.3 Our responsibility for supervising the Student begins at the scheduled start of the Course or, where we provide an arrival transfer, at the agreed pick-up point and time; and ends at the scheduled end of the Course or, where we provide a departure transfer, on hand-over at the agreed drop-off point. We are not responsible for the Student before or after these times, including during any independent travel to or from the campus.
15. Liability
15.1 Nothing in these Terms excludes or limits our liability where it may not lawfully be excluded or limited, including liability for death or personal injury caused by our fault, or arising from fraud or gross negligence (Article 1229 of the Italian Civil Code).
15.2 Subject to clause 15.1, our liability towards you is limited to cases of wilful misconduct or gross negligence, in accordance with Italian law. We are not liable for loss, theft of or damage to personal belongings, nor for indirect or consequential loss, nor for acts of third parties outside our organisation, nor for the consequences of a Student's conduct contrary to instructions or of events beyond our reasonable control.
15.3 Our duty of supervision over minor participants under Articles 2047 and 2048 of the Italian Civil Code is unaffected by these Terms.
16. Force Majeure
16.1 Neither party is liable for failure or delay in performing its obligations caused by events beyond its reasonable control, including acts of God, natural disasters, epidemics or pandemics, government measures, acts of terrorism, war, or transport disruption (a "Force Majeure Event").
16.2 If a Force Majeure Event prevents us from delivering a Course, we will, at your option, offer a credit note for a future Course or a refund of Fees paid for the affected Course elements, without further liability for incidental or consequential costs. If the event continues for more than four weeks, either party may terminate the affected booking on written notice.
17. Data Protection and Image Rights
17.1 We process personal data in accordance with the GDPR (Regulation (EU) 2016/679) and Italian data-protection law (Legislative Decree No. 196/2003, as amended by Legislative Decree No. 101/2018). The processing of the Student's and the Parent's data, including health data, is described in the Privacy Notice provided as part of the Enrolment Documents.
17.2 Photographs and audio/video recordings of the Student are used only with the separate consent given in the Enrolment Documents, which you may withdraw at any time as described in that consent.
18. Governing Law and Jurisdiction
18.1 The Agreement is governed by Italian law.
18.2 The courts of Milan, Italy shall have jurisdiction over any dispute arising out of or in connection with the Agreement. Where you act as a consumer, this does not deprive you of the protection of the mandatory provisions of the law of your country of residence, nor of any right you have to bring or defend proceedings before the courts of your place of residence (the consumer's forum under Article 33 of the Italian Consumer Code and applicable EU rules).
19. General
19.1 No variation of these Terms is effective unless agreed in writing. If any provision is found invalid or unenforceable, the remaining provisions continue in force. This Agreement does not create any partnership or agency between the parties and is not intended to benefit any third party.
19.2 These Terms may be provided in English for the convenience of international families. In the event of any conflict of interpretation with the Italian-language version, the Italian text prevails.
19.3 Any course materials provided to the Student are for the Student's personal use only. All intellectual property rights in them remain with SPORTECH or its licensors; they may not be copied, resold or distributed to any third party without our written consent.
20. Specific Approval of Clauses (Articles 1341 and 1342 of the Italian Civil Code)
Pursuant to Articles 1341 and 1342 of the Italian Civil Code, the Parent, having read them, specifically approves the following clauses: 3.2 (acceptance/refusal of bookings), 3.5 (change of location), 5.2-5.7 (payment, price errors, late-payment interest and cancellation for non-payment), 6.1-6.3 (cancellation and refund terms), 7 (cancellation and changes by us), 9 (visa terms and administrative fee), 10 (amendments and additional costs), 11.2 (compensation), 12 (removal from the Program and repatriation costs), 13 (insurance), 15 (limitation of liability), 16 (force majeure) and 18 (governing law and jurisdiction).
